Representative Matters

  • Defended a hotel owner and a management company against breach of contract and fraud claims arising out of the purchase of $101 million resort property in which plaintiffs sought $30 million in compensatory damages and untold punitive damages. After a three week trial, the jury returned a verdict of no liability in favor of the firm's client.
  • Represented several national real estate resort and hotel investment firms and the owners of world-class luxury hotels in ADA litigation involving accessibility of public accommodations in Title III lawsuits in New York, California and Illinois.
  • Defended the seller of a casual restaurant chain against a claim that it had breached certain representations and warranty in connection with sale of its business. By presenting a detailed analysis refuting the purchaser’s claims, SR negotiated a favorable settlement in which our client paid less than 25% of amount claimed by purchasers.
  • Represented a hotel and resort owner in $1 million dispute regarding early termination of a management contract for failure to perform duties in compliance with industry standards. Negotiated settlement favorable to client and avoided payment of claimed early termination fee.
  • Represented a hotel owner and management company in an insurance coverage dispute involving a “fidelity” policy. Negotiated the recovery of approximately $400,000 to cover losses suffered due to employee theft.
  • Represented an international hotel management company in a lawsuit regarding the insurer's overcharge of premiums for a workers' compensation policy.
  • Represented a Chicago-based restaurant in connection with the successful prosecution of a trademark infringement case in the United District Court for the Northern District of Illinois.
